General terms and conditions (GTC) of the Spring and Autumn Institute (Ltd.)

1. Scope of application
The general terms and conditions (GTC) of the Spring and Autumn Institute (Ltd.) are valid for all seminars and training courses offered.
2. Application procedures
The application is to be made either in writing, even by fax transmission, or via an application form provided on one of the online platforms put up for this purpose.
The courses etc. can take place only, if the necessary number of subscribers is met. Applications will be acknowledged in the order of their being sent in. All subscribers will receive a confirmation of their application along with further information.
A possibly offered rebate on early booking can only be awarded if the application was sent in at due date (on the last day of the time span tied up for early booking at the latest) and on the condition of full payment of the fee for the seminar or training course in question not later than seven days after the time span arranged for early booking.
Special agreements, variations or side deals are to be acknowledged in writing.
3. Cancelling clause
The contract can be cancelled at any time without stating any reasons. In this case the following conditions must be observed.
1. Seminars and training courses with a time span for early booking:
- If the booking is cancelled at the very last day of the time span arranged for early booking, at the latest, the complete seminar fee will be refunded.
- The seminar fee cannot be refunded if the cancelling arrives too late or the participant does not appear.
2. Seminars etc. without a time span arranged for early booking:
- If the booking is cancelled up to 4 weeks before seminar start, the seminar fee will be refunded in full.
- 50% of the seminar fee will be refunded, if the cancelling arrives 2 weeks before seminar start at the latest.
- After 2 weeks before seminar start or if the participant does not appear, no refunding will be possible.
The cancelling fee need not be paid, if the subscriber offers another potential participant applicable to the target group in question. This person is supposed to attend the seminar or teaching course and to pay the participant fee in full. The relevant date is the day the opting-out arrives at our office.
4. Alterations in our lecturing programme
Because of our long-term planning changes of our programme might occur. We reserve the right to cancel lectures, courses etc. if the necessary number of participants is not attained or if lectures etc. must be cancelled because of force majeure or if the instructor is prevented by illness or accident or because of any other circumstances that cannot be influenced by the SAAI. In all these cases the SAAI can ask another equally qualified lecturer to step in or even cancel the event at short notice. The subscribers will at any rate and immediately be informed by telephone or in writing. If the lecture or course in question must be cancelled without replacement the course fee will be refunded in full.
In case a course date must be postponed or a new lecturer steps in and this refers to a single in itself coherent block of teaching events the potential participants have the right to withdraw from the contract. They will be refunded either proportionally (the lectures in question consist of several event blocks) or completely (lectures at only one single date).
We reserve the right to possibly cancel additional bookings (like full board, shuttle service etc.) if the number of participants is too low or if capacity limits must be taken into consideration. The subscribers will at any rate be immediately informed either by telephone or in writing.
Otherwise, claims of compensation are excluded.
5. Liability
Any damage suffered by the participant in connection with or during a lecture etc.goes to his disadvantage. We do not accept any liability for that. The participant is fully responsible for the way he makes use of or applies the knowledge acquired in course. As to misleading influence we refer to our domestic authority. In such cases all further claims expire at once.
Preventive measures taken by other participants or by the course or seminar leaders are entirely at own risk.
Claims because of damages are excluded.
As to slight alterations of the pre-arranged teaching contents by the lecturer SAAI does not take upon any liability.
6. Pledge of secrecy
The participants are committed to observe secrecy as to all information they are given about patients respectively other participants.
7. Copyright
All materials and media belonging to them are the personal property of the lecturer and are protected by copyright. Every passing-on, multiplication, even by way of extract, or employment for non-licensed teaching activity are possible only under preceding permission given by the rightful owner in writing. Abuse will be prosecuted.
8. Data protection
All facts and figures transmitted to us will be treated confidentially according to the data protection law.
9. Safeguard clause
Even if singular regulations of the above general terms and conditions should partially or entirely be or become legally invalid or void the rest of the regulations would remain unaffected by this.
10. Sundries
The conditions of contract are principally based on German law.
Place of jurisdiction is Schleiz.
